Employment and Workplace Use of AI 

 

The use of Artificial Intelligence (“AI”) has evolved from a costly experimental technology into an essential, cost-effective operational mainstay for organisations across industries, including in India. It now drives tasks like resume screening, interview scheduling, performance reviews, job satisfaction analysis, attrition forecasting, and even redundancy determinations. Given India's intricate employment law framework spanning central and state statutes, constitutional safeguards, and judicial precedents amid a workforce rich in social, political, and economic diversity, employers must ensure AI outputs align with diversity mandates to prevent biased decision-making. 

 

AI in Hiring Processes  

 

AI tools for resume screening or video interviews risk bias if trained on skewed data, potentially discriminating on grounds prohibited under Article 15 of the Indian Constitution (e.g., caste, gender) or the Rights of Persons with Disabilities Act. Employers bear liability for discriminatory outcomes, as courts may deem opaque “black-box” decisions arbitrary under natural justice principles, requiring explainability and human review. No mandates exist for pre-deployment audits, unlike the EU AI Act, leaving firms to self-assess via DPDP impact assessments for Significant Data Fiduciaries (“SDFs”). 

 

AI in Workplace: India’s Regulatory Framework 

 

The use of AI in hiring, performance management, employee monitoring, or termination is governed by existing labour laws, constitutional principles of fairness and privacy, and data protection obligations. AI systems do not possess legal personality, and any decision taken using AI tools is legally attributable to the employer. Automation does not dilute employer responsibility or reduce the legal standards applicable to workplace decision-making. 

 

The principal legal risk arises where AI systems are used to take or influence adverse employment decisions without transparency or meaningful human oversight. Indian courts and labour authorities are likely to apply principles of natural justice, including non-arbitrariness and reasoned decision-making, even where outcomes are generated through automated tools. An employer cannot shield itself from scrutiny by characterising a decision as algorithm-driven if the effect is adverse to an employee or applicant. 

 

AI-enabled employee monitoring raises distinct privacy concerns. Continuous or intrusive surveillance may violate constitutional expectations of privacy, particularly where monitoring is disproportionate, lacks adequate notice, or extends beyond legitimate business purposes. These risks are accentuated in remote and hybrid work settings, where AI-based productivity and behavioural monitoring tools are increasingly deployed. 

 

The governance framework is based on four Labour Codes- Code on Wages, Industrial Relations Code, Social Security Code, and Occupational Safety), the Digital Personal Data Protection Act, 2023 (“DPDP Act”), and constitutional rights under Articles 14, 19, and 21. The Industrial Relations Code emphasises fair procedures in disciplinary actions.  

 

From a data protection perspective, the DPDP Act applies squarely to employee personal data processed through AI systems. While employers may rely on deemed consent for employment-related processing, they remain bound by obligations of purpose limitation, data minimisation, reasonable security safeguards, and accountability. AI-driven profiling or behavioural analytics that go beyond legitimate employment purposes may therefore attract regulatory scrutiny.

Practical Possible Solutions for Businesses 

 

  • Human-in-the-Loop Review: Retain meaningful human oversight across all high-stakes employment decisions, including hiring, promotions, disciplinary proceedings, and terminations. AI outputs must function as advisory inputs rather than binding outcomes human decision-makers should independently evaluate context, corroborate evidence, and record their reasoning for endorsing or overriding recommendations. This upholds natural justice principles under the Industrial Relations Code and guards against allegations of unreasoned or mechanical action. 

  • Explainability of AI Outputs: Guarantee that AI-generated scores, rankings, or recommendations in employment settings are understandable and defensible to stakeholders. Establish protocols mandating decision-makers to explain AI's role in outcomes (e.g., "low performance score due to missed KPI on project delivery, validated through team feedback"), steering clear of opaque "black-box" dependence. This fulfils DPDP Act transparency requirements and constitutional due process norms. 

  • Internal Disclosures and Policies: Publish employee-accessible notices and detailed policies detailing AI applications in monitoring, evaluation, and decisions. Cover specifics like data types (e.g., keystrokes, video analytics), objectives (e.g., productivity tracking), storage durations, and rights (e.g., access, objection, appeals). Secure acknowledgements via onboarding, annual refreshers, and policy updates to affirm notice and proportionality. 

  • Bias Testing Protocols: Execute routine and independent bias audits on recruitment and appraisal systems, screening for overt discrimination (e.g., gender or caste signals) and covert proxies (e.g., postal areas linked to socio-economic exclusion). Utilise representative training data, enforce fairness benchmarks (e.g., equalised selection rates), and log remediation actions like data rebalancing or variable exclusion. For Significant Data Fiduciaries under DPDP, third-party validation strengthens compliance evidence. 

  • Recruitment-Specific Controls: When implementing AI for recruitment, train models on datasets that incorporate not just historical hires but also compliance boundaries and the organisation's forward-looking hiring criteria. This enables the system to identify strong candidates without entrenching prior inequities. Preserve human judgment for ultimate selections, ensuring AI augments rather than supplants recruiter expertise. 

  • Performance Management Safeguards: Configure AI performance tools to account for reasonable accommodations, preventing unfair penalties for employees needing adjustments. Tailor KPIs and targets to individual competencies, roles, and growth paths, with AI aiding skill gap analysis and progress monitoring. Human supervisors retain authority to contextualise results, apply nuance, and finalise evaluations. 

  • Investigations and Disciplinary Actions: For AI-assisted workplace probes, supply models with pertinent cultural, organisational, and legal context, while curating diverse stakeholder inputs for balanced fact-finding. Refine AI-suggested questions to reflect case-specific histories and sensitivities. Position AI as a supportive tool only, with trained investigators or managers holding final responsibility for findings, hearings, and sanctions. 

  • Data Protection and Bias Safeguards: Bolster safeguards through compulsory bias audits for employment AI, alongside opt-out options for fully automated decisions where practicable. Impose internal penalties for deploying flawed or biased datasets, and empower employees with rights to contest, correct, or withdraw consent for AI processing, reinforcing DPDP's accuracy, purpose limitation, and accountability mandates. 

 

Competition Law and AI-Driven Market Behaviour  

 

AI in the workplace is not confined to HR pricing algorithms, recommender systems, and data‑driven strategies also shape competition in labour and product markets. The Competition Act, 2002 does not provide exemptions for algorithmic decision-making, and pricing algorithms, recommender systems, and data-driven strategies are assessed under existing substantive standards from the legislation.  

 

The Competition Commission of India’s (“CCI”) market study on Artificial Intelligence and Competition highlights concerns around algorithmic collusion, data concentration, self‑preferencing, and opacity. For example:  

 

  • Algorithmic Pricing and Cartel‑Like Risks: Independent pricing algorithms deployed by competitors may converge on supra‑competitive prices even without explicit communication, raising cartel‑like concerns. 

  • Data Concentration and Entrenched Market Power: Firms with large proprietary datasets and advanced models may entrench market power in ways that are harder to detect and remedy using traditional competition tools. 

  • Merger Control and Scrutiny of AI Driven Transactions: AI‑related mergers and acquisitions are also scrutinised under deal‑value thresholds, particularly where data and algorithms are the key assets. Enterprises therefore need competition‑focused audits of pricing and recommendation algorithms, documentation of independent decision logic, and careful analysis of AI‑intensive transactions. 

 

A key competition risk arises from AI systems facilitating coordinated outcomes without explicit human agreement. Independent pricing algorithms may converge on supra-competitive pricing, potentially producing cartel-like effects. AI may also enable firms with access to large proprietary datasets to entrench market power in ways that are difficult to detect using traditional antitrust tools. AI-driven acquisitions are subject to heightened scrutiny under India’s deal value thresholds, particularly where data and algorithms constitute the primary competitive asset. 

 

Cross-Border and International Considerations 

 

Many workplace AI tools are cloud‑based or offered by foreign providers, making jurisdiction and data transfer issues central. Models are trained on data sourced globally, hosted on cloud infrastructure distributed across jurisdictions, and deployed to users and decision‑makers in yet more countries. As a result, AI no longer sits neatly within a single legal system or policy framework. Instead, it operates across overlapping regimes of data protection, trade, human rights, financial regulation, export control and competition law. 

 

One of the foundational questions in cross‑border AI is: whose law applies? A single AI system may be developed in one country, trained using datasets from others, hosted on servers in a different region, and used to make decisions about individuals and entities across the world. Traditional concepts of territorial jurisdiction sit uneasily with such distributed architectures. 

 

In India, the DPDP Act has extraterritorial reach where processing is connected to offering goods or services to individuals in India, or involves personal data collected in India. The IT Act similarly extends to offences involving computer systems or networks located in India. Sectoral regulators, particularly in financial services, impose additional data localisation and audit access requirements that directly affect AI deployment models. Alongside DPDP, the IT Act, 2000, and sector‑specific regulations, especially in financial services, impose data localisation, security, and audit‑access obligations that directly influence AI deployment models. For instance, regulated entities may be required to store certain categories of financial data within India and ensure that regulators have access to logs and models used in automated decision‑making. 

 

  1. The Emerging International AI Governance Layer 

 

Although AI regulation is still primarily national or regional, an important “soft law” layer of international standards and principles has emerged. These instruments do not replace domestic law but strongly influence it and serve as convergence points for crossborder compliance strategies. Key frameworks include: 

 

  • OECD AI Principles (2019, updated 2024): the first intergovernmental standard on AI, adopted by OECD members and additional partners. They promote innovative, trustworthy AI that respects human rights and democratic values, and have influenced over 1,000 policy initiatives worldwide.​ 

  • UNESCO Recommendation on the Ethics of Artificial Intelligence (2021): a global, nonbinding standard adopted by all UNESCO member states. It emphasises human rights, transparency, fairness, human oversight and robust data governance, and provides detailed policy action areas that translate highlevel ethics into regulatory measures. 

  • Council of Europe Framework Convention on Artificial Intelligence (2024): the first legally binding international treaty on AI governance, open beyond Europe, aimed at aligning AI development and use with human rights, democracy and the rule of law.10 

  • ISO/IEC 42001:2023 (AI Management System): the world's first international standard specifying requirements for establishing, implementing, maintaining and improving an AIMS. It supports risk and impact assessments, ethical practices, transparency and cross-border harmonisation, making it valuable for EU AI Act alignment and global compliance. 

 

India’s approach to international AI governance is cooperative, but autonomy-focused. While India aligns with Organisation for Economic Co-operation and Development (OECD) principles on responsible and human-centric AI, it has consciously avoided adopting a comprehensive risk classification regime similar to the EU AI Act. Instead, India relies on principle-based governance, sectoral supervision, and existing legal frameworks. International standards such as ISO IEC 42001 have been adopted domestically through the Bureau of Indian Standards, signalling convergence without hard legislation. 

 

  1. AI Cross-Border Governance Advantage: Practical Steps for Businesses 

 

Given this complexity, the question for boards and executives is how to operationalise cross-border AI governance in a way that is sustainable and commercially sensible. A pragmatic roadmap would typically include: 

 

  1. Map AI systems and cross border touchpoints: Catalogue AI usecases (internal and external), including data sources, training and inference locations, vendors, APIs and user geographies. Identify where personal data, sensitive data or dualuse functionality is involved, and where remote access or cloud processing may amount to a “transfer”. 

  2. Identify applicable regimes and high risk jurisdictions: For each significant AI system, determine which data protection, AI specific, sectoral, export control and sanctions regimes are triggered by virtue of establishment, targeting or data subject location. Flag high risk combinations (e.g. EU/UK data processed in non-adequate countries; deployments into China, Russia or other sensitive destinations; biometrics or surveillance use cases). 

  3. Adopt a harmonised internal standard anchored in global principles: Use international frameworks (OECD AI Principles, UNESCO Recommendation, the Council of Europe Convention and recognised risk management standards like NIST AI RMF or ISO 42001) as the baseline for internal AI policy. Where local law is stricter, layer local requirements on top; where it is looser, maintain the higher global standard to avoid fragmentation. 

  4. Engineer for jurisdictional flexibility: Design systems with configurable risk controls: different transparency layers, logging, human in the loop thresholds and content filters based on jurisdiction. Consider data minimisation, regional hosting, federated learning and robust encryption to reduce transfer and localisation pressures. 

  5. Strengthen contractual and vendor governance: Incorporate clear allocation of responsibilities for compliance with AI, data protection, IP and export control rules in cross border contracts. Require vendors to disclose data sources, model characteristics, risk assessments and sub-processing arrangements, and to support audits where appropriate. 

  6. Embed continuous monitoring and incident readiness: Establish central AI governance forums that track regulatory developments across major markets (EU, US, UK, India, China, Brazil, etc.) and translate them into design and operational requirements. Prepare cross border incident playbooks, covering not only data breaches but also algorithmic failures, bias incidents, export control issues and sanctions breaches. 

 

Enforcement Trends and Regulatory Outlook 

 

AI enforcement remains nascent but is accelerating globally, with indirect actions through data protection, employment and consumer laws predominating where dedicated AI regimes lag.  

 

India has not yet seen large-scale AI-specific enforcement actions. Regulatory engagement has primarily taken the form of advisories, market studies, and supervisory dialogue. Enforcement has occurred indirectly through existing statutes where AI deployment results in data breaches, unfair trade practices, or regulatory violations. Globally, enforcement is gaining momentum.  

 

  • Hiring and bias cases: In 2015, Amazon scrapped its AI hiring tool for penalising women's resumes due to flawed historical data.1 iTutor Group's algorithm rejected women over 55 and men over 60 automatically, while University of Washington tests revealed LLMs favouring white-associated names 85% of the time, female names 11%, and never Black male names over white ones.2 Unchecked model development risks pattern detection linking to protected traits through proxies, so organisations must rigorously test algorithms to uncover and mitigate indirect discrimination against vulnerable groups. 

  • EU and broader trends: The EU AI Act phases in full enforcement by August 2026, with penalties up to 7% of global turnover for high-risk violations; early actions focus on prohibited practices and general-purpose models. US state laws and EEOC actions proliferate amid federal fragmentation.3 

 

The regulatory trajectory points toward increased supervision rather than immediate omnibus legislation. The proposed Digital India Act is expected to introduce targeted obligations for high-risk AI systems. Sectoral regulators are likely to harden guidance into enforceable requirements over time. Importantly, the Data Protection Board of India has already been constituted and is operational under the DPDP framework, making data protection enforcement a key AI-adjacent risk area.

 

Conclusion: Preparing for a More Demanding Decade 

 

The next decade will see AI governance shift from voluntary principles and isolated enforcement actions to a dense mesh of binding cross border obligations, overlapping supervisory authorities and hard national security constraints. At the same time, international frameworks are creating an increasingly coherent vision of what “trustworthy” AI looks like – humancentric, rights respecting, transparent, accountable and risk based. 

 

For businesses, the strategic choice is whether to treat this environment as a patchwork of minimum standards to be reluctantly met, or as an opportunity to build robust, interoperable governance that enables participation in multiple markets with confidence. Organisations that invest early in cross-border aware AI architecture, harmonised internal policies and integrated legal technical governance will be best placed to scale AI innovation globally without being paralysed by conflicting rules or reputational crises.  

 

In an era where AI knows no borders but laws still do, competitive advantage will belong to those who learn to navigate – and help shape – this evolving international terrain.
